Abstract

This paper addresses the laws governing the use of tracking and tracing devices by police officers when investigating crimes, analysing the most recent Supreme Court rulings. It focuses on the prerequisites for legality, attaching particular emphasis to the concurrence of the principles of speciality, necessity, suitability and proportionality in court approval; also studying cases of police emergency.
